I. General provisions

1. The NEY ART SHOP online store (hereinafter referred to as “NEY ART SHOP” or “Store”) is operated by Monika Papko conducting business under the name of NEY GALLERY & Prints Monika Papko with its registered office in Warsaw (01-248) at Jana Kazimierza Street 68 lok. U11, having tax identification number NIP: 5222885639 and REGON 146976883,

2. The orderer (also referred to as the “Customer”) may be an adult natural person, legal person or organizational unit without legal personality, who, after properly undergoing the procedure of registration on the site, gained access to the services offered by NEY ART SHOP.

3. Placing an order in the NEY ART SHOP online store signifies the Customer's acceptance of the rules of sale arising from these Regulations and obliges the Customer to abide by them.


II. Placing orders

1. Orders can be placed using the order form located on the Store's website, as well as electronically at: info@neyartshop.com.

2. It is also possible to place an order in writing via traditional mail (registered mail) to the address: Jana Kazimierza Street 68 lok. U11, 01-248 Warsaw.

3. NEY ART SHOP is not responsible for incorrect data provided by the Customer.

4. NEY ART SHOP informs that the personal data provided by the Customer, are collected on a voluntary basis, will serve to implement the order and will not be made available to third parties, except in cases of mandatory provision of information specified in the laws in force on the territory of the Republic of Poland and when the Customer gives his consent. In accordance with the Act of August 29, 1997 on the protection of personal data (consolidated text: Journal of Laws 2015, item 2135, 2281, as amended), the Customer has the right to inspect his data and the right to correct them.

5. The placement of an order by the Customer is each time confirmed by NEY ART SHOP within 48 hours of receiving information about the order placement. This confirmation does not constitute a declaration of intent by NEY ART SHOP to accept the order and is for informational purposes only.


III. Payment

1. The prices of works and services can be found on the NEY ART SHOP website, are given in Polish zloty (PLN) and are gross prices (including VAT).

2. The prices given do not constitute an offer within the meaning of civil law.

3. At the request of the Customer, notified before the shipment of works, a VAT invoice is issued for each order.

For this purpose, in the order form it is necessary to provide all the data necessary to issue a VAT invoice.

Any errors in the data contained in the VAT invoice must be reported within 7 days from the date of receipt of the invoice, under pain of disregarding the complaint.

4. The Orderer may make payment by choosing one of the following forms:

a) by payment card; NEY ART SHOP shall not be liable in any way if the Ordering Party uses the payment card of an entity that has not authorized the use of its card;

b) by bank transfer to the bank account number indicated below:

The payment takes effect when the NEY ART SHOP bank account is credited. In the case of choosing bank transfer rather than payment by card, the Purchaser should notify NEY ART SHOP staff at (+48) 606991653, in order to shorten the process of sending works.


IV. Realization of the order

1. The order will be fulfilled provided that the selected works are available in the Store's warehouse.

2. The store reserves the right to refuse to process an order at any stage of its execution in exceptional cases, such as for important economic or logistical reasons. In particular, this applies to the case in which there would be an obvious and glaring discrepancy between the price or data of the presented object and reality due to a mistake or technical fault. The customer of such a case is always informed in advance by the Store staff.

3. Ordered works are delivered to the place indicated by the Customer at his expense. The conditions and possibility of shipping works abroad are agreed individually with the Customer.

4. Delivery of works can be carried out by courier, snail mail or in the form of personal collection by the Customer. The cost of delivery is determined individually each time, as it depends on the quantity and size of the ordered works.
 

5. Order processing time is usually up to 7 working days and is calculated:

a) from the moment NEY ART SHOP confirms the purchase offer - in case of choosing the form of payment by cash or credit card on delivery;

b) from the moment NEY ART SHOP's bank account is credited - in case the Orderer chooses the Orderer's form of payment by bank transfer or payment card.

6. If it is not possible to complete the delivery within the time limits specified above, NEY ART SHOP will contact the Customer immediately, informing him of the expected delivery date.


V. Receipt of goods

1. Receiving the shipment in the presence of the courier, the Customer should check the external condition of the packaging and the condition of the works in the shipment.

2. If any damage to the works is found at the time of receipt, the Customer is obliged to take the following actions:

   a) prepare a written report of damage to the shipment in the presence of the courier or in any other manner accepted by the courier;

   b) file a claim with the courier, proceeding in accordance with the general terms and conditions of carriage applicable to the respective carrier, in particular in the appropriate form and time limit;

   c) inform NEY ART SHOP of the circumstances by telephone or in electronic form.

3. In the event that the Customer accepts the shipment without reservation or the Customer fails to take the actions described in paragraph 2 letters a-c, NEY ART SHOP shall not be liable for any damage to the delivered works existing at the time of delivery.

4. In the event that the Customer fails to collect the shipment from the courier, which is then returned by the courier to NEY ART SHOP, the Store shall not be liable for damage to or loss of the shipment, unless this is a consequence of circumstances for which it is solely responsible. In such a situation, the Customer shall pay to NEY ART SHOP a contractual penalty in the amount of 4 times the cost of the shipment in question within 7 days from the last day on which the Customer could collect the works from the carrier.

5. If the Customer chooses the option of personal collection and does not pick up the purchased works within 14 days, NEY ART SHOP reserves the right to realize the shipment of the paid works at the expense of the Customer.


VI. Withdrawal from the contract by the Customer

1. The Customer has the right to withdraw from the contract within 14 days from the date of receipt of the shipment, without giving any reason, by sending to NEY ART SHOP a written statement by electronic mail (e-mail) to the following address: info@neyartshop.com or to the postal address: NEY Gallery & Prints Monika Papko, 68 Jana Kazimierza Street, U11, 01-248 Warsaw.

2. In the above case, the Client should immediately contact NEY ART SHOP in order to determine the detailed terms and conditions of the order.

3. NEY ART SHOP will refund to the customer the amounts paid for the ordered goods within 14 days from the return acceptance of the shipment by the Store, provided that none of the goods bear traces of use or damage.


VII. Complaints

1. Differences in the appearance of the works delivered with the ordered works viewed on the Store's website, which differences may result from the settings (parameters) of the screen on which the Customer viewed the works, do not constitute grounds for complaint.

2. NEY ART SHOP shall be liable under warranty if a physical defect in the works is found before the expiration of two years from the date of delivery to the Customer.

3. The customer is obliged to report the defect within 14 days from the date of its perception.

4. In order to exercise the rights arising from NEY ART SHOP's liability for non-conformity of the contents of the shipment with the contract, the Customer should give NEY ART SHOP appropriate notice and contact the Store to determine the details of the complaint procedure.
 

5. Notice of non-conformity of the contents of the shipment with the contract should include: order number, names / titles of works, circumstances justifying the complaint, including a description of the possible non-conformity (defect), determination of the moment when the non-conformity of the work with the contract became apparent, and consent to the processing of personal data of the Client for the purposes of the complaint procedure.

6. Claims in the scope of NEY ART SHOP's liability for non-compliance consumer goods with the contract should be reported to the electronic mail address (e-mail): info@neyartshop.com, in writing to the address: Jana Kazimierza Street 68 lok. U11, 01-248 Warsaw or in person at the NEY ART SHOP premises.

7. The costs incurred by the Customer in connection with the implementation of the complaint, NEY ART SHOP shall bear only in the case of confirmation that the reported non-compliance of the order with the contract actually exists.

8. In order for the Customer to exercise his/her rights under the above provisions, the works must not be in contact with water, must not be placed/hung in wet places, must not be stored near adhesives, solvents and any other chemicals, must not be bent, rubbed, scraped or glued with anything.

VIII. Final provisions

1. Any disputes arising in connection with the execution of orders between NEY ART SHOP and the Customer shall be resolved in the first instance by negotiation, with the intention of concluding the dispute amicably. However, if this would not be possible or would be unsatisfactory to either Party, all disputes shall be settled by the common court in Warsaw with jurisdiction over NEY ART SHOP's registered office.

2. The descriptions of the works and their images are taken from the database owned by NEY ART SHOP.

3. Except as permitted by law or as a result of obtaining permission under the copyright, reproduction of the works in any part is strictly prohibited.
